Terms of Service
Effective date: April 16, 2026
1. Acceptance of Terms
By accessing or using the LVLUP mobile application and website ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old to use LVLUP. If you are under 18, you must have parental or guardian consent. By using LVLUP, you represent that you meet these requirements.
3. Account Registration
You must create an account to use certain features. You are responsible for keeping your login credentials secure. You agree to provide accurate information and to notify us if your account is compromised.
4. User Content
- You retain ownership of content you post (videos, text, images).
- By posting, you grant LVLUP a worldwide, non-exclusive, royalty-free license to display, distribute, and promote your content within the Service.
- You must not post content that is illegal, harmful, threatening, abusive, defamatory, or infringes on the rights of others.
- Completed journey content becomes a permanent highlight and cannot be deleted once the day has passed.
5. Journeys
When you start a journey, you commit to posting daily for the chosen duration. Missed days are permanently recorded. Completed journeys are automatically saved as profile highlights. Journeys with uploaded, time-locked days cannot be deleted.
6. EXP, Support, and Creator Payments
What EXP is. EXP is a digital good — an in-app virtual item issued by LVLUP for use exclusively within the LVLUP mobile application and website. 1 EXP represents 1 USD cent of support spending power inside the platform. The denomination is for pricing reference only; EXP itself is not currency.
EXP:
- has no monetary value, no exchange value, and no liquidation value outside the LVLUP platform;
- is not legal tender, not a deposit, not a stored-value instrument under the meaning of any money-transmission law, not a security, not a derivative, not a financial product, and not a cryptocurrency, virtual asset, or token of any kind;
- is not subject to the licensing requirements of the Central Bank of Oman or any equivalent foreign banking, payments, or money-transmission authority, because no person other than LVLUP holds redemption rights against EXP and EXP cannot be transferred outside the platform;
- is non-transferable — EXP cannot be sold, traded, gifted, assigned, or otherwise transferred to any other person, account, service, wallet, or platform outside LVLUP;
- accrues no interest, earns no yield, and confers no equity, voting, governance, dividend, or ownership rights of any kind in LVLUP;
- has a single purpose — it is consumed exclusively to support content creators' journeys within the platform, and has no other utility;
- cannot be redeemed, exchanged, or cashed out by the purchasing user under any circumstances. Returning the EXP balance to a user as cash is not a feature offered by the platform.
EXP is purchased via Apple In-App Purchase (iOS), Google Play Billing (Android), or Tap Payments (web). Pricing on iOS reflects Apple's 30% in-app purchase fee. The purchase transaction is exclusively between you and LVLUP — you are buying a digital good from LVLUP, not sending money to any creator, user, or third party. Where EXP is purchased through Apple or Google, those platforms are the merchant of record for that storefront purchase, in accordance with their respective developer agreements.
Supporting a creator (no peer-to-peer payment). When you spend EXP to support a creator's journey, you are consuming the digital good in exchange for in-platform participation in that creator's content. No money is transferred between you and the creator at any point in this flow. Internally, LVLUP records the transfer of EXP units from your wallet ledger to the creator's wallet ledger; this is an in-platform bookkeeping event, not a peer-to-peer payment, money transmission, remittance, or hawala. EXP sent to a creator is held in escrow until that creator's journey completes:
- If the creator completes the journey, 80% of the EXP is released to the creator's in-platform earnings ledger and 20% is retained by LVLUP as its platform fee. The 80%/20% split is consideration LVLUP receives for hosting, distribution, payment processing, KYC, fraud prevention, and platform operation.
- If the creator fails (3 missed days) or the journey otherwise ends without completion, 100% of the EXP is returned to the supporter's in-platform wallet as in-app EXP — not as cash. This automatic in-app return is an operational mechanic of the escrow ledger; it is not a refund of the original digital-good purchase, does not give rise to any right to receive cash, and does not entitle the supporter to convert the returned EXP into money.
Creator payments as compensation for content. When a creator's in-platform earnings ledger reaches the minimum payout threshold and the creator opts into a payout cycle, LVLUP — at its sole discretion — pays cash to the creator's verified payee account in exchange for that creator's accumulated EXP-denominated entitlement against the platform. This payment is:
- structurally a B2B-style payment from LVLUP to the creator, in exchange for content the creator has delivered on LVLUP and the audience engagement they have generated;
- not a transfer of money from any individual supporter to the creator, and not the discharge of any user-to-user obligation;
- not a withdrawal of "stored value" — the creator does not have a deposit account with LVLUP, and EXP held in the creator ledger is not a balance held in trust or kept in a segregated cash account belonging to the creator;
- governed by a separate Creator Agreement that the creator must accept before opting into payouts. The Creator Agreement covers payee KYC, AML screening, withholding-tax obligations, payout currency, payout method (handled by our licensed payment partner), and minimum / maximum payout amounts.
Creators are independent contractors. LVLUP does not act as the creator's employer, agent, escrow agent for users, or fiduciary. Creator income from LVLUP payouts is reportable on the creator's own tax returns; LVLUP issues the documentation required by applicable tax law (e.g. annual statements) and may apply withholding where required by the creator's jurisdiction or by Oman tax law.
Standard digital-good creator-platform model. The structure described above is the standard digital-good creator-platform model. In LVLUP:
- The user buys a digital good from the platform — not from another user.
- The platform — not the supporting user — is the counterparty paying the creator.
- The creator's payout is consideration from the platform to the creator in exchange for content delivered on the platform; it is structurally a B2B-style payment, not a remittance from supporter to creator.
- There is no money flow from the supporting user to the creator. This keeps the model outside the regulated zones of money transmission, peer-to-peer remittance, hawala, and licensed money-services activity.
LVLUP is the merchant of record for the digital-good purchase (or, where applicable, Apple / Google is the storefront merchant of record), and LVLUP is the payor of record for the creator payout. No third-party money-transmission license, no electronic-money-issuer authorization, and no payment-services-provider authorization is required for this structure under the laws of the Sultanate of Oman, as confirmed by the design described in this Section 6.
Account closure and EXP forfeiture. EXP is consideration for in-platform support and has no cash redemption right. If your account is closed (whether by you or by LVLUP for cause), any unspent EXP balance is forfeit upon closure and may not be redeemed for cash, transferred, or carried over to any other account. For account-closure-by-user, you are encouraged to spend your EXP on creator support before initiating closure. For account-closure-by-LVLUP for cause (fraud, abuse, AML hits, or terms violation), unspent EXP is forfeit immediately and is not refundable. Apple / Google store-level refunds processed by those platforms remain governed by their policies.
AML, fraud, and reporting. LVLUP screens both purchase and payout flows for fraud and money-laundering indicators. LVLUP cooperates with Omani regulatory authorities, including the Central Bank of Oman and the Financial Information Unit, and with foreign authorities where applicable. Suspicious transactions may be frozen, investigated, and reported in accordance with Royal Decree No. 30/2016 (Anti-Money Laundering and Combating Financing of Terrorism Law) and Royal Decree No. 28/2009 and their implementing regulations.
6a. Purchases are Final — Refund Policy
All EXP and digital-good purchases on LVLUP are final and non-refundable, except in the limited circumstances described below. This is the standard purchase-finality model for in-app digital goods.
- Spent EXP is non-refundable in all circumstances. Once you transfer EXP to a creator (whether the creator's journey is in progress, completed, or failed), the EXP has been consumed by your purchase of in-platform support and cannot be refunded to you. If a creator's journey fails or is terminated, EXP is returned to your in-platform wallet as EXP — not as cash.
- Apple App Store and Google Play purchases: If you bought EXP through the App Store or Google Play, all refund requests must be made directly to Apple or Google through their respective billing flows (e.g. Apple's "Report a Problem" page at reportaproblem.apple.com). LVLUP does not control and cannot process refunds for store-billed purchases. If Apple or Google grants a refund, the corresponding EXP is debited from your balance, which may produce a negative balance you'll need to clear before further support spending.
- Tap Payments (web) purchases — billing problems only: For purchases made directly via Tap, LVLUP may, at its sole discretion, process a goodwill refund only for verified billing problems: unauthorized charges, accidental duplicate purchases, or fraudulent transactions. Refund requests of this kind must be reported via the in-app "Report a billing problem" form. We will review and respond within 7 business days. Goodwill refunds are not granted for "I changed my mind", "I no longer want to use the platform", or unspent-balance withdrawal requests.
- Required by law: Where applicable consumer-protection law mandates a refund right that overrides the policy above, LVLUP will honor it. Submit such requests in writing to support@lvlup.om with a description of the legal basis for the request.
- Statutory cooling-off / immediate-access consent. By tapping "Buy" or otherwise initiating an EXP purchase, you expressly consent to immediate access to the digital good and acknowledge that performance of the purchase begins as soon as the EXP is credited to your wallet. In jurisdictions that grant a statutory cooling-off period for distance-sold digital content (for example, the EU's 14-day right of withdrawal under Directive 2011/83/EU, Article 16(m)), this consent operates as a waiver of that cooling-off right to the extent permitted by applicable law.
- Minors and parental refunds. Users under 18 must have parental or guardian consent to use LVLUP and to make purchases (see Section 2). Where a parent or legal guardian establishes that a minor made a purchase without their authorization, LVLUP will process a refund consistent with applicable consumer-protection law, after age and consent verification. For purchases made through the App Store or Google Play, parental refund requests must be raised through Apple or Google directly, since those purchases are billed by them.
- Submission channel. Billing-problem reports must be submitted through the in-app "Report a billing problem" form. Reports sent through any other channel (email, social media, third-party platforms) will be redirected to the in-app form so that all reports flow through a single, auditable review queue.
- Chargebacks and disputes. Initiating a chargeback or payment dispute on a purchase that does not qualify under the categories above may result in suspension of your account and forfeiture of any remaining EXP balance pending resolution. We strongly prefer you file an in-app billing-problem report first — it's faster and avoids the consequences of a chargeback.
6b. Creator Payouts
- EXP credited to a creator from a completed journey is paid out to the creator on the 15th of each month, processed by our licensed payment partner to the creator's verified payee account. Minimum payout: $25. The payout is a B2B payment from LVLUP to the creator in exchange for delivered content; it is not a transfer of money from any individual supporter.
- LVLUP is not a bank and does not provide banking, lending, or investment services. EXP balances are stored credits within the platform; they are not legal tender and do not accrue interest. LVLUP holds operational funds in segregated accounts pending payout settlement.
- LVLUP reserves the right to freeze EXP balances and reverse transactions suspected of fraud, money laundering, or abuse, in accordance with applicable Omani law (Royal Decree No. 28/2009 and Central Bank of Oman regulations).
7. Prohibited Conduct
You may not:
- Use the Service for any illegal purpose.
- Harass, bully, or intimidate other users.
- Attempt to manipulate EXP balances, bypass rate limits, or exploit the support, escrow, or refund systems.
- Use bots, scrapers, or automated tools to access the Service.
- Impersonate another person or entity.
8. Moderation and Reporting
Users can report content and other users. LVLUP reserves the right to remove content and suspend accounts that violate these Terms, at our sole discretion.
9. Intellectual Property
LVLUP and its branding, design, and code are the property of LVLUP. You may not copy, modify, or distribute any part of the Service without permission.
10. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.
11. Limitation of Liability
To the fullest extent permitted by law, LVLUP shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
12. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance. We will notify users of material changes via the app or email.
13. Governing Law
These Terms are governed by the laws of the Sultanate of Oman. Any disputes shall be resolved in the courts of Muscat, Oman.
